Acceptance

By accessing or using the site, you agree to these Terms, the Privacy Policy, and the User Policy. If you do not agree, do not use interactive functionality or submit information. These Terms do not replace a signed service agreement; a signed agreement controls if it conflicts.

Educational and informational purpose

The website, assessments, scores, comparison bands, reports, articles, AI-supported responses, sessions, and resources are general education, research, self-reflection, and informational material. They are not medical, psychiatric, psychological, psychotherapeutic, legal, financial, investment, accounting, tax, lending, fiduciary, crisis, or other licensed professional advice.

No professional-client, attorney-client, physician-patient, therapist-client, fiduciary, or similar relationship is created by visiting the site, completing an assessment, receiving a report, communicating through a form, or using AI-supported technology.

Emergencies and professional care

Do not use this site for an emergency or to diagnose, treat, prevent, or manage any condition. Contact appropriately licensed professionals before acting on information involving health, mental health, medication, law, taxes, investments, credit, lending, safety, or regulated matters. Call emergency services when danger may be immediate; in the United States, call 911 or call/text 988 for crisis support.

Assessments and private browser reports

Assessments are not validated clinical, psychometric, legal, financial, employment, insurance, credit, or diagnostic instruments. The DISC-inspired profile is an original educational reflection and is not an official DISC product. Current personalized results are generated from voluntary self-ratings and stored in the user’s browser rather than placed in the page URL. Freedom Clarity drafts and reports are designed to expire after 30 days. Local expiration cannot remove summaries the user authorized us to receive, screenshots, emails, printouts, downloads, device backups, or other copies.

No guarantees and atypical results

We do not promise or guarantee revenue, profit, funding, rankings, leads, clients, employment, health, fitness, relationship, family, legal, spiritual, media, publishing, or other outcomes. Testimonials, examples, case studies, projections, illustrations, and exceptional success stories do not represent a promise or typical outcome. The most extreme successes are unusual, depend on many factors, and are not easily duplicated. Results vary.

Your responsibility

You are responsible for independent judgment, due diligence, the accuracy and legality of information you submit, obtaining licensed advice, protecting private links, evaluating AI output, and every decision or action you take. You understand that delay, action, or reliance may carry risks unique to your circumstances.

Communications

If you request contact and provide contact details, you authorize service-related communications responding to that request. Marketing communications remain subject to applicable consent and opt-out requirements. Message and data rates may apply. Reply STOP to supported marketing texts and use unsubscribe controls in marketing email.

Intellectual property

Unless otherwise stated, site text, frameworks, assessments, branding, designs, media, software, and downloadable materials are owned by or licensed to Joshua T. Fleming or associated entities. You may use them personally and noncommercially. You may not reproduce, sell, scrape, train a competing model on, publish, or create derivative commercial products without written permission.

Third parties and technology

Third-party hosting, email, social, AI, analytics, advertising, visitor-identification, enrichment, scheduling, payment, and communication providers have their own terms and practices. We do not control their availability, security, accuracy, caching, or actions.

Disclaimer of warranties

To the fullest extent permitted by law, the site and content are provided “as is” and “as available,” without warranties of accuracy, completeness, fitness for a particular purpose, merchantability, noninfringement, availability, security, or uninterrupted operation. Some jurisdictions do not allow certain exclusions, so portions may not apply to you.

Limitation of liability and hold harmless

To the fullest extent permitted by law, Joshua T. Fleming, Local Digital Buzz, and their owners, personnel, contractors, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, opportunities, data, goodwill, or business; or decisions made from educational content. You agree to defend and hold these parties harmless from claims arising from your unlawful misuse, unauthorized disclosure, infringement, or violation of these Terms. Nothing limits liability or rights that applicable law does not permit to be limited or waived.

Indemnity

To the extent permitted by law, you agree to indemnify the covered parties for third-party claims, losses, costs, and reasonable legal fees caused by your unlawful conduct, content, misuse of sharing features, violation of another person’s rights, or material breach of these Terms.

Governing law and disputes

Unless a signed agreement states otherwise or applicable consumer law requires another result, these Terms are governed by Florida law, without regard to conflict-of-law principles. Before filing a non-emergency claim, the parties should attempt good-faith informal resolution. Venue and any arbitration terms should be confirmed by qualified counsel before reliance.

Changes, severability, and contact

We may update these Terms prospectively. If one provision is unenforceable, the remaining provisions remain effective to the extent permitted. Questions may be submitted through the website contact or strategy-call form.

Joshua Fleming’s credentials and professional limits

Joshua Fleming has completed Christian counseling education and has extensive experience in fitness, nutrition education, body transformation, business strategy, mentoring, and advocacy. He is not licensed or currently credentialed as a therapist, mental-health counselor, psychologist, physician, dietitian, nutritionist, personal trainer, attorney, accountant, lender, broker, investment adviser, financial adviser, or other regulated professional. Descriptions of education, experience, mentoring, coaching, or past client outcomes must not be interpreted as active professional licensure.
